Terms of Service

1. Introduction

These terms of service ("Terms") govern your use of the website at voltaplugins.com (the "Site"), your participation in our beta programme, and the support we provide in connection with Voltaverb and any other software we publish (together, the "Software"). By accessing the Site or using the Software, you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Software.

Your use of the Software itself is additionally governed by the End User License Agreement (EULA). Our handling of your personal data is described in our Privacy Policy. In the event of any conflict, the EULA governs your rights to use the Software, and these Terms govern everything else.

3. Eligibility

To use the Site, purchase a licence, or participate in the beta programme, you must be at least 18 years old and legally able to enter into a binding contract under the laws of the jurisdiction in which you reside. By using the Site or the Software, you confirm that you meet these requirements.

4. Use of the website

You may use the Site for your own lawful, personal, or professional purposes. You must not:

  • Use the Site in any way that breaches any applicable law or regulation
  • Attempt to gain unauthorised access to any part of the Site or any systems connected to it
  • Introduce viruses, malicious code, or other harmful material
  • Conduct any kind of automated data collection or scraping without our prior written consent
  • Use the Site in a way that could damage, disable, overburden, or impair it, or interfere with anyone else's use of it

5. Intellectual property in Site content

All content on the Site — including text, graphics, logos, images, audio demos, the Voltaverb interface imagery, and the Volta Plugins name and logo — is owned by or licensed to Volta Plugins Ltd and is protected by copyright, trade mark, and other intellectual property laws. You may view and download content from the Site for your own personal or professional reference, but you may not reproduce, modify, distribute, or commercially exploit it without our prior written permission.

6. Purchasing Voltaverb

Purchases of Voltaverb licences are processed through Gumroad, which acts as the merchant of record for sales to buyers in the United Kingdom and the European Union. This means that when you buy a licence:

  • Gumroad is the party that sells the licence to you and processes your payment
  • Gumroad is responsible for collecting and remitting any applicable VAT or other sales taxes
  • Your purchase is also subject to Gumroad's terms of service and privacy policy

Volta Plugins Ltd is the developer and licensor of the Software. Your rights to install and use Voltaverb are granted under the EULA.

7. Pricing and currency

Prices for Voltaverb are displayed on the Site and in the Gumroad checkout. The current retail price is £195 (or equivalent in your local currency as displayed by Gumroad). Prices are shown inclusive or exclusive of VAT depending on your location, in line with Gumroad's checkout behaviour; the final price and any applicable taxes will be clearly displayed before you confirm your purchase.

We reserve the right to change prices at any time. Changes will not affect licences already purchased.

8. Refunds and 30-day money-back guarantee

We offer a 30-day money-back guarantee on every Voltaverb purchase. If, within 30 days of your purchase, you are not satisfied with the Software for any reason, you may request a full refund by contacting us at support@voltaplugins.com. We will authorise the refund through Gumroad, who will return the amount to your original payment method.

This 30-day guarantee is offered in addition to, and does not limit or replace, any statutory rights you may have as a consumer under the laws of your country of residence, including (where applicable) your rights under the UK Consumer Rights Act 2015.

After the 30-day period has expired, refunds are at our discretion and will generally only be considered where the Software is not working as described and we have been unable to resolve the issue through support.

9. Delivery of the Software and licence activation

When your purchase is complete, Gumroad will email you a receipt and a link or code to access your licence. You may then download the Software from voltaplugins.com and activate it using the licence key provided. Activation requires an internet connection. Once activated, the Software can be used on up to three computers concurrently, subject to the restrictions in the EULA.

We aim to deliver licence keys and download links immediately on purchase. If you do not receive your licence key within a reasonable time, please contact support@voltaplugins.com.

10. Support and updates

We provide email support at support@voltaplugins.com. We aim to respond within a reasonable time but do not guarantee specific response times or that all issues can be resolved.

All v1.x updates of Voltaverb are provided free of charge to licensees. Major version upgrades (v2.0 and beyond) may be paid upgrades, potentially with loyalty discounts for existing customers. We will communicate the details of any such upgrade clearly before it becomes available.

11. Beta programme

If you participate in a Voltaverb beta programme:

  • The beta version of the Software is provided on an "as is" basis, may contain bugs, and may change significantly before release
  • You agree to treat the beta Software and any information we provide about it as confidential, and not to share, publish, or distribute the Software, licence keys, screenshots, or descriptions of unreleased features without our prior written consent
  • You agree that any feedback, suggestions, or bug reports you provide may be used by us, without obligation to you, to improve the Software
  • Beta licences may be time-limited and may stop functioning at the end of the beta period
  • We may terminate your participation in the beta programme at any time for any reason

12. Availability of the Site and licence server

We try to keep the Site, our licence activation service, and our download servers available at all times, but we do not guarantee uninterrupted availability. We may suspend, withdraw, or restrict the availability of all or any part of the Site or the activation service for business, operational, or maintenance reasons, and will try to give reasonable notice where practicable.

The Software is designed to continue functioning during short periods of offline use. Voltaverb provides a 30-day offline grace period between online verifications. Our commitment to provide a Perpetual Build in the event we permanently cease trading is set out in Section 9 of the EULA.

13. Third-party services

The Site and Software interact with third-party service providers, including Gumroad (payments and merchant of record), Mailchimp (newsletter), Formspree (contact and feedback forms), Railway (licence activation), Cloudflare (CDN and security), and Namecheap (hosting). Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for the acts, omissions, or content of third-party services, except as set out in our contracts with them and as required by law.

14. Our liability to you

14.1 If you are a consumer

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory rights as a consumer under the UK Consumer Rights Act 2015 (including that any digital content we supply must be of satisfactory quality, fit for purpose, and as described); or any other liability that cannot be lawfully excluded under the laws of your country of residence.

Subject to the above, if we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable.

14.2 If you are a business

If you are using the Site or the Software for the purposes of your trade, business, craft, or profession, then to the maximum extent permitted by law:

  • We exclude all implied conditions, warranties, representations, or other terms that may apply to the Site, the Software, or any content on it
  • We will not be liable for any loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill, or reputation; or any indirect or consequential loss or damage
  • Our total liability to you for all claims arising out of or in connection with the Site, the Software, or these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount you paid us for the relevant Voltaverb licence in the twelve months preceding the event giving rise to the claim

15. Events outside our control

We are not responsible for any failure or delay in performing our obligations under these Terms where such failure or delay is caused by events outside our reasonable control, including but not limited to acts of God, failures of public or private telecommunications or hosting infrastructure, cyber-attacks, strikes, or acts of any government.

16. Termination

We may suspend or terminate your access to the Site, the licence activation service, or the beta programme if you materially breach these Terms, the EULA, or applicable law. Termination does not affect any rights, liabilities, or obligations that have accrued before termination.

17. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when they were most recently revised. Where changes are material, we will communicate them through the Site or by email to affected users where appropriate. Your continued use of the Site or the Software after the updated Terms take effect constitutes your acceptance of the changes.

18. Other terms

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be reformed only to the extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be considered a waiver of that right or provision. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign or transfer our rights and obligations to any successor entity.

19. Governing law and jurisdiction

These Terms, their subject matter, and their formation are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. If you are a consumer resident outside England and Wales, you may also have the right to bring proceedings in the courts of your country of residence, and nothing in this paragraph is intended to limit any such rights you may have under applicable mandatory consumer protection laws.
